Delivery and Transit Waiver
Delivery
Off-site (home or workplace) delivery of a vehicle is subject to approval by the selling dealer. Original Equipment Manufacturers (OEMs) and individual dealerships maintain their own policies, requirements, and restrictions; Automotive Ally cannot compel a dealer to provide off-site delivery.
If a dealer approves off-site delivery, you acknowledge and agree that the transaction will be completed under the same terms, conditions, and customer obligations as an on-site delivery conducted by the selling dealer. To the extent permitted by Tennessee law and applicable dealer/OEM policy, any inspection, return, or cancellation periods that otherwise apply to an on-site delivery apply to an off-site delivery. By electing off-site delivery through Automotive Ally, you accept these terms.
You are responsible for reviewing and signing all sales and financing documents provided by the selling dealer. Automotive Ally is not a dealer, lender, or insurer and does not take title to vehicles or funds.
Questions regarding eligibility or effects of off-site delivery should be directed to the selling dealer.
In Transit Liability
Your insurance must cover the car during transport. Make sure your policy (or binder for the new car) is active from the moment the dealer releases the vehicle until it’s delivered to you.
Automotive Ally may contract to a carrier/driver/notary for delivery. They are not our employees or agents.
Risk during transit isn’t on us. If the car is damaged, delayed, or lost in transit, your recourse is with the transporter and/or your insurer, not Automotive Ally. Inspect the car at delivery and note issues on the bill of lading.
Release of liability. You agree that Automotive Ally isn’t responsible for transit damage, delays, storage fees, or loss of use, except for our willful misconduct.
You’ll handle claims and protect us from third-party claims related to transport, except for our willful misconduct.
